{"id":12744,"date":"2018-09-16T15:07:43","date_gmt":"2018-09-16T15:07:43","guid":{"rendered":"https:\/\/europeanobsndfr.org\/?p=12744"},"modified":"2018-09-16T16:06:08","modified_gmt":"2018-09-16T16:06:08","slug":"poverty-is-a-violation-of-fundamental-rights","status":"publish","type":"post","link":"https:\/\/europeanobsndfr.org\/en\/actualites-fr\/asylum-migration-and-borders\/poverty-is-a-violation-of-fundamental-rights\/","title":{"rendered":"Poverty is a violation of Fundamental Rights."},"content":{"rendered":"<p style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">1\/<\/span> The European Charter of Fundamental Rights sets out the basic rights that must be respected both by the European Union and the Member States when implementing EU law.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>The European Charter of Fundamental Rights is a legally binding instrument<\/strong> that was drawn up in order to expressly recognise, and give visibility to, the role of fundamental rights in the legal order of the Union.<br \/>\n<u><\/u><\/p>\n<div class=\"ep-a_text\" style=\"text-align: justify;\">\n<p>European Parliament has focused in particular on the issue of codifying <strong>Fundamental Rights <\/strong>in a legally binding document. In\u00a01994, it drew up a list of the Fundamental Rights guaranteed by the Union. It placed special emphasis on the drafting of the Charter by making it \u2018one of its constitutional priorities\u2019<a class=\"ep-p_text erpl_scroll_anchor\" href=\"http:\/\/www.europarl.europa.eu\/factsheets\/en\/sheet\/146\/the-charter-of-fundamental-rights#_ftn2\" name=\"_ftnref2\"><\/a> and stipulating the requirements to be met. In particular:<\/p>\n<\/div>\n<div class=\"ep-a_text\" style=\"text-align: justify;\">\n<ul>\n<li><strong>The European Charter needed to be given fully binding legal status by incorporating it into the TEU<\/strong><em> (\u00ab\u00a0A Charter [\u2026] constituting merely a non-binding declaration and [\u2026] doing no more than merely listing existing rights would disappoint citizens\u2019 legitimate expectations\u00a0\u00bb);<\/em>\u00a0European Parliament thus called for the Charter to be incorporated into the Treaty of Nice and the new Constitutional Treaty ;<\/li>\n<li><strong>Fundamental Rights needed to be recognised as indivisible<\/strong>, by making the European Charter applicable to all the institutions, bodies and policies of the EU, including those under the second and third pillars, in the context of the powers and functions conferred upon it by the Treaties.<\/li>\n<\/ul>\n<\/div>\n<div class=\"ep-a_text\" style=\"text-align: justify;\">\n<p>European Parliament has regularly called for the EU to accede to the ECHR, stressing that this would not duplicate the role of the now binding Charter. It called several times for the establishment of <strong>the European Agency for Fundamental Rig<\/strong>hts.<\/p>\n<\/div>\n<div class=\"ep-a_text\" style=\"text-align: justify;\">\n<p>In two resolutions in\u00a02014, Parliament also called for the creation of a \u2018Copenhagen mechanism\u2019, which would constitute a more efficient tool to ensure that Member States fully respect the fundamental values of the Union and the requirements of Democracy and the Rule of Law.<\/p>\n<p>On 25\u00a0October\u00a02016, European Parliament adopted a resolution with recommendations to the Commission on the establishment of <strong>an EU mechanism on Democracy, the Rule of Law and Fundamental Rights<a class=\"ep-p_text erpl_scroll_anchor\" href=\"http:\/\/www.europarl.europa.eu\/factsheets\/en\/sheet\/146\/the-charter-of-fundamental-rights#_ftn4\" name=\"_ftnref4\"><\/a>.<\/strong><\/p>\n<\/div>\n<div class=\"ep-a_reference\" style=\"text-align: justify;\">\n<div class=\"anchor\">\n<p><strong><span style=\"text-decoration: underline;\">2\/<\/span> Work must provide full access to Fundamental Rights<\/strong>.<\/p>\n<p>Each situation of Poverty, despite a full-time work as described in this article below, is<strong> a violation of Fundamental Rights.<\/strong><\/p>\n<p>The Associations in charge of helping people in precarious situations, without public subsidies, have a heavy burden.<\/p>\n<p><strong>Poverty, because of a lack of access to housing, a lack of access to health, a lack of access to work or vocational training, is always a violation of Fundamental Rights in itself.<\/strong><\/p>\n<p><strong><u>Learn more about\u00a0poor workers :<\/u><\/strong>\u00a0<span style=\"text-decoration: underline;\"><strong><a href=\"https:\/\/www.lemonde.fr\/economie\/article\/2018\/09\/05\/les-travailleurs-pauvres-ces-invisibles_5350536_3234.html\">https:\/\/www.lemonde.fr<\/a><\/strong><\/span><\/p>\n<\/div>\n<\/div>\n<p style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Learn more about the Charter of Fundamental Rights <\/span>:\u00a0<span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.europarl.europa.eu\/factsheets\/en\/sheet\/146\/the-charter-of-fundamental-rights\">The Charter of Fundamental Rights<\/a><\/span><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>1\/ The European Charter of Fundamental Rights sets out the basic rights that must be respected both by the European Union and the Member States when implementing EU law.
