✅ The European Observatory for Non-Discrimination and Fundamental Rights shares the findings of the surrogacy and sale of children study presented by Mrs Maud de Boer-Buquicchio, Special Rapporteur on the sale and sexual exploitation of children at the 37th session of the United Nations Human Rights Council.

✅ Most of the surrogacy agreements practiced, including in developed countries, are nothing more than the sale of children, regardless of the legal devices used.

✅ Our position is that :

  • the Surrogacy can only be the subject of a universal and definitive abolition by International Treaties ; 
  • it must be into account, among other Treaties, the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), the Convention on the Rights of the Child, the Convention on Slavery and Additional Protocol to the United Nations Convention against Transnational Organized Crime to Prevent, Suppress and Punish Trafficking in Persons, especially Trafficking in Women and Children ; 
  • there can’t be any « ethical slavery » in the matter of Surrogacy.

✅ L’Observatoire Européen de la non-discrimination et des droits fondamentaux partage le constat de l’Etude sur la gestation pour autrui et la vente d’enfants présentée par Madame Maud de Boer-Buquicchio, Rapporteuse spéciale sur la vente et l’exploitation sexuelle des enfants à l’occasion de la 37 ème session du Conseil des droits de l’Homme des Nations-Unies.

✅ L’essentiel des conventions de gestation pour autrui pratiquées, y compris dans les pays développés, ne sont rien d’autre que de la vente d’enfant, quels que soient les artifices juridiques employés.

✅ Notre position est que :

  • la Gestation pour autrui ne peut donc que faire l’objet d’une abolition universelle et définitive par des Traités Internationaux ;
  • en droit, doivent être pris en considération,  entre autres, la Convention sur l’élimination de toutes les formes de discrimination à l’égard des femmes (CEDAW), la Convention des Droits de l’Enfant, la Convention relative à l’esclavage et le Protocole additionnel à la Convention des Nations‐Unies contre la criminalité transnationale organisée visant à prévenir, réprimer et punir la traite des personnes, en particulier la traite des femmes et des enfants ;
  • il ne saurait exister « d’esclavage éthique », en matière de gestation pour autrui.
